That’s unusual the EEOC typically only injects itself into an individual employee’s dispute when it perceives that the employee’s case presents an issue of public concern. First, the Equal Employment Opportunity Commission filed the three latest lawsuits on behalf of the employee. Q: Did anything surprise you while conducting your research? We wrote this article to help make hospitals aware of potential legal challenges based on religious discrimination claims and help them ensure their own mandates are well-written and reasonably applied in order to avoid legal challenge and maintain a healthy and productive workplace. Having a policy that requires health-care workers to be vaccinated helps protect employees themselves but also the patients they take care of, who are often at high risk of serious complications from influenza. This is good policy: influenza is a serious disease and voluntary programs have had disappointing results. Mello: More and more hospitals are mandating their employees get vaccinated against influenza. Q: What prompted you to undertake this research and write about the subject? Stanford Health Policy asked Mello and Sonne questions about their research and findings. Yet antibodies made in response to vaccination with a certain set of influenza viruses can sometimes provide protection against different but related viruses. Preliminary estimates suggest that this season’s influenza vaccine is about 40 percent effective. So far this season, an influenza A virus called H3N2 has been the most common form of influenza. The CDC estimates that 34 million Americans got the flu that season more than 700,000 were hospitalized and about 56,000 people died. The Centers for Disease Control and Prevention reports that this influenza season has claimed the lives of 37 children and is on track to rival the 2014-2015 flu season. The paper comes during what could be the worst flu season since the 2009 swine flu pandemic. In particular, when and how must health-care workers’ religious objections be accommodated to conform to the law?” “But they create thorny problems when it comes to exemptions. “These policies are an important public-health strategy since vaccination rates for health-care workers continue to fall short of the Healthy People 2020 target of 90 percent,” the authors write. Opel, MD, MPH, an assistant professor of pediatrics at the University of Washington. Their article is co-authored with Douglas J. Sonne, JD, an associate professor of law and director of Stanford Law School’s Religious Liberty Clinic, write in this week’s New England Journal of Medicine that the EEOC litigation “is cause for unease” among the growing number of hospitals with mandatory influenza-vaccination policies. Michelle Mello, PhD, JD, a professor of health research and policy and professor of law, and her colleague James A. Facing a full-blown trial in February, the hospital agreed to settle the case on January 12, compensating the employees and revising its vaccination mandate policy. The lawsuit, which alleges that the hospital violated Title VII of the Civil Rights Act of 1964, is one of a trio of lawsuits in the past two years in which the EEOC has intervened to challenge vaccination mandates for health-care workers. In April 2016 the Equal Employment Opportunity Commission (EEOC) sued Mission Hospital, a large North Carolina health system, after it denied employee requests for religious exemptions from an influenza-vaccination requirement. He had already been sexually abusing the girl since she was 11, and there is no doubt she expected to be sexually abused once more when she followed him to the basement. On Monday, Fritzl had admitted to the court that on August 28, 1984, just days after she turned 18, he asked Elisabeth to help him fix a door in the basement of the family home in Amstetten, Austria, where he claimed to be building a bomb shelter. “It was his playground,” Burkheiser told the court. She told the jury that Elisabeth spent 24 years wondering when she would be raped again and, maybe worse, what would happen to her and her children if he never returned. Burkheiser said that no matter how bad the sexual abuse got, the uncertainty was worse. On Wednesday Fritzl also pleaded guilty to slavery, a crime that has never been tried in the Austrian court system. Austrian media have reported that Elisabeth testified that, “Michael began to suffer breathing problems, his skin turned blue and his legs started to stiffen.” Her father then took the baby away saying, “What will be will be.” He made them after watching video taped testimony by his daughter Elisabeth, who was excused from appearing in court, but according to press reports may have secretly attended the proceedings." Her testimony will now help determine whether he is remanded to prison or a psychiatric ward.Įlisabeth had told police that the baby she named Michael was born alive and could have been saved with medical treatment. The new pleas mean that Fritzl will certainly receive a life sentence. The trial will continue to determine sentencing, with a verdict expected by Friday. Originally he said the baby was stillborn, but on Wednesday he said: "I was hoping the little one would survive but I should have done something. In a surprise twist, on Wednesday, Fritzl also pleaded guilty to murdering one of his newborn twins. On Monday, Fritzl, 73, pleaded guilty to charges of rape, incest, false imprisonment, and coercion. It was like this, she said, turning the light on and off in the courtroom. “Have you ever wondered what it was like in the cellar?” she asked the four men and four women as she passed around the box. The 33-year-old Austrian prosecutor, Chritsiane Burkheiser, is doing her best to transport the eight jurors to that underground hell where Fritzl lured his daughter just days after she turned 18. When he was angry, Fritzl would turn off the electricity or fail to deliver food for days at a time, leaving the four captives hungry and cold in the dark. Elisabeth bore all seven children on her own, cutting the umbilical cords with a pair of rusty scissors. One, a twin, was burned in an incinerator in the backyard after allegedly dying from respiratory problems at birth. Three were raised upstairs by Elisabeth’s mother, who claims to have known nothing of the horror below. Three of those children were raised in the dark cellar with Elisabeth. This was where Fritzl raped his captive daughter more than 3,000 times, fathering seven children. No one outside the closed courtroom knows for sure what was in that box, but we do know that it smelled like a dark, damp place where water seeped from the walls a space closed off from sunlight and void of any normality for nearly a quarter of a century. On the first day of Josef Fritzl’s rape, incest, and murder trial in Sankt Poelten, Austria, the chief prosecutor passed around a brown cardboard box with items taken from a dungeon below his house. Sometimes the smell of mold can be more horrible than the smell of death. It was so harrowing that it led her father to confess-Now he faces life in prison. This sentimental ending ignores the difficult realities of Sarah's traumatizing experience and makes romance the main focus - which feels disingenuous in the face of such a life-and-death situation.Testifying by videotape, Elisabeth Fritzl described her years of torment, repeatedly raped by her father Josef and trapped with the children of incest in a dank cellar. At the end of "The Girl in the Basement," her real-life prince Chris shows up on his motorcycle, rescuing her on a ride to their happily ever after. She portrays herself as a fairy princess whose wings have been clipped by her evil father because she loves a prince. Similarly to "Room," Sarah invents a fairy tale story to help her children understand her past and their distressing present. There is no visible change in her physical performance or makeup to show signs of aging, making the time jumps feel artificial. Our only clue as time passes is when Sarah repeatedly turns to reveal her newly pregnant belly, like a jump scare in a horror film. The story moves at a breakneck pace, never giving its lead actor Stefanie Scott time to showcase her psychological pain. Unfortunately, this adaptation of the Fritzl case is very presentational and does not delve into the character's inner turmoil. We can’t ungroup the SVG because it will release and possibly lose the clipping mask. If we zoom in, we can see a small area that we don’t want in the cropped result. However, the ADA guidelines referenced in this article apply specifically to the United States and designers in other countries should be sure to cross-reference them with their local codes and regulations. AutoCAD drawings of urinals, squat toilets in plan, front and side elevation view. Keep in mind that similar to codes, things like clear floor space and wheelchair maneuvering space are given in the guidelines as a minimum-you can always design more generously and it’s always good practice to keep universal design in mind on any public project.įor those reading this outside the United States, many of the standards are likely shared broadly across countries. The most recent version of the design standards for public spaces was released by the Justice Department in 2010 and it is what designers follow today. Municipalities do not have to adopt ADA in the way they adopt other building codes it is already mandatory. Because of its status as law, compliance is not optional. The Americans with Disabilities Act (ADA) of 1990 is a civil rights law in the United States that prohibits discrimination based on disability. Check out the whole document here if you need it-or for convenience, each subheading in this article links directly to the relevant section in the PDF! Keep reading for a quick summary (all information and diagrams are directly from the guidelines). Luckily for designers in United States, the documentation for the ADA Standards for Accessible Design is available online. This guide aims to describe each chapter in the ADA 2010 guidelines to give a foundation for navigating them. Remember that these should not be used instead of specific details. They are not created with borders or layers and must be modified to fit the designer’s CAD standards. However, once you understand the layout and how to use a code book or the ADA guidelines, they become more manageable. I have arranged the figures of the 2010 ADA in 24×36 format sheets that architects and designers can use for their construction documents. Over time you’ll likely become familiar with the types of things you need to look out for on a project, but even the most experienced architects may still need to double-check a code question or two during the design process (or have an intern check it for them.) Unfortunately, many code documents are unwieldy to say the least, and there are few cases in which this is more true than the 279-page ADA Standards for Accessible Design. There’s no doubt that it’s daunting and it can certainly pose challenges to your design. Only a special few architects can truly say they enjoy reading building codes. Female cats have two X chromosomes, which means they can be OO (dominant orange), oo (recessive orange, which results in the cat being some other color), or they can be Oo, which is tricolor. Since a male cat has only one X chromosome, if he carries the orange gene, he is either OY (orange) or oY (some other non-orange color). The O gene can only be carried on the X chromosome. There is a color gene for orange cat coat color that is noted as O. (See image below for example.)įun calico cat fact:A calico is the official state cat of Maryland!Ĭurious why calico cats are almost always female? Well, the truth is in the genes! Here’s how it works: Any cats with large piebald type white, orange, and black patches are calico cats.Īdd a tabby pattern into the mix with a calico cat and you have a cat called a caliby! There are also cats that are “diluted” calicos, which have gray rather than black on their coat coloring. A calico cat can come in a wide array of coat patterns, and no two really ever look identical. These predominantly female –as well as usually very loving–cats are rather easy to recognize once you know exactly what to look for: orange, black and white. They are also called “patched tabbies” since they are a tabby with patches of red or cream. When a cat has tabby stripes but also tortoiseshell markings, this results in what is known as a torbie. The term “torbie” is short for tortoiseshell-tabby, and they were once referred to as reverse torties. Of the four type of cat coat colors listed, the torbie cat is most rare. What is a tricolor cat? Calicos, tortoiseshells, and torbies all belong to a category of cat colors called tricolor. Cole and Marmalades’ housemates, Jugg and Zig Zag, are both torbies! A tortie can also have a diluted coat that’s not as bold, but still be considered a tortie by definition. You may see small white spots, but usually, Torties have a predominance of black and red fur color. The only way to be sure if you have a tortie or torbie is to ignore any stripes showing in the red or cream areas – just look to see if the black color is solid or has stripes. Here’s something to keep in mind when establishing the difference:Įven on a solid color cat, you can often see stripes on reds and creams. In the United States, tortoiseshells are sometimes referred to as money cats.įor some people (myself included!), it can be slightly difficult to determine the difference between torbie and tortie cat coat color. Even today, the Irish and Scottish believe stray tortoiseshell cats bring them luck. Dating back to Celtic times, tortoiseshell cats have been perceived to bring good fortune into their homes. Their appearance is a healthy mix of dark black or chocolate, with shades of red, ginger, or orange mixed in.įun tortoiseshell cat fact: In many cultures, tortoiseshell cats are synonymous with good luck. Since torties are not specific to any particular breed of cat, their overall coloring typically appears brindled. If you’ve got a tortie, then you know exactly what we mean by tortitude! A collage of examples of tortie cats: A tortie cat is known by many for being a cat with attitude and a distinct personality with a voice all of their own. Tortoiseshell markings appear in many different breeds, as well as in non-purebred domestic cats.įor those cat owners who share their home with one of these colorful cats, they often report of their cat’s ““tortitude” with others. And in the rare instances that a tortoiseshell cat is male, it will typically be sterile as a result. Similar to calicos, tortoiseshell cats are almost exclusively female. Tortoiseshell Catsīy definition, a tortoiseshell cat is a feline with a coat that resembles the mottled or particolored shell of a tortoise. If you’ve ever wondered what exactly makes a torbie, tortie, calico or tabby cat, we’re here to tell you!Ĭheck out our detailed overview on how to tell the difference between torbies, torties, calico and tabby cat coat colors. (Although I must say, there will always be a special place in my heart for ginger tabbies!) Speaking of which, did you know there are different classifications for tabbies? Not all have solid stripes, actually, and some have stripes which are darker/bolder than others. Really, I don’t discriminate, I just love them all despite their markings, fur length or coat color. I love cats that come in all sizes, shapes and colors.
